Terms of Use
These terms apply to every iOS app published on the App Store under the seller name Sebastian Doyle that links to this page (each an "App"). By downloading or using an App you agree to them. Nothing in these terms removes rights you have under consumer law where you live (see sections 7 and 8).
1. Who we are
The Apps are published by Sebastian Doyle, an individual developer ("we", "us"). Contact: sebastian.doyle@outlook.com.
2. Licence: Apple's Standard EULA
Your licence to use each App is granted under Apple's Licensed Application End User License Agreement (Standard EULA), which is incorporated into these terms. These terms add to the Standard EULA. If they conflict, the Standard EULA applies, except where these terms give you more rights.
3. Purchases and auto-renewing subscriptions
- All purchases, including subscriptions and one-time ("lifetime") unlocks, are made through Apple's App Store and are billed to your Apple Account when you confirm the purchase. We never see your payment details.
- Subscriptions renew automatically at the price and for the period shown at purchase, unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- To cancel, open iOS Settings > [your name] > Subscriptions (or the App Store app > your account > Subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you have paid for.
- If a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription.
- If a subscription price goes up, Apple will tell you and, where the law or Apple's rules require it, ask for your consent before renewing.
- Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. This does not limit your rights in sections 7 and 8.
- Restore previous purchases on a new device with the App's "Restore Purchases" option, using the same Apple Account.
4. Using the Apps
- Use the Apps lawfully and only for personal, non-commercial use, unless we agree otherwise.
- Do not try to copy, reverse engineer, get around purchase checks, or interfere with the Apps, except where the law allows.
- You are responsible for the content you create or store in an App, and for backing up your device.
5. Information, not professional advice
The Apps provide tools, estimates and general information only. They are not medical, health, fitness, safety, financial, legal or other professional advice. Examples: fitness, sun, sound-level, colour or measurement readings are estimates from phone sensors and may be inaccurate; logging apps do not tell you whether something is safe. Use your own judgement, follow the law and safety rules, and see a qualified professional where appropriate.
6. Changes and availability
We may update, change or stop offering an App or a feature. If you have paid for a subscription and we remove a significant paid feature during a period you have paid for, you may be entitled to a remedy under sections 7 and 8.
7. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded. Where our liability for failing to meet a guarantee can lawfully be limited, it is limited (at our choice) to supplying the service again or paying the cost of having it supplied again.
8. UK and EU/EEA consumers
If you are a consumer in the United Kingdom, you have statutory rights under the Consumer Rights Act 2015, including that digital content must be of satisfactory quality, fit for purpose and as described. If you are a consumer in the EU/EEA, you have the rights given by the consumer law of the country where you live, including under the Digital Content and Services Directive (EU) 2019/770. You may also have a right to cancel a purchase within 14 days, subject to the conditions set by law and by Apple at the point of sale. Nothing in these terms affects those statutory rights, and nothing in section 9 limits liability that the law does not allow to be limited.
9. Liability
Subject to sections 7 and 8, and to the extent the law allows, the Apps are provided "as is", and we are not liable for indirect or consequential loss, or for loss of data you have not backed up. We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited by law.
10. Privacy
Each App has its own privacy policy, linked from the App and its App Store page, which explains what data it processes and your rights under the UK GDPR, the EU GDPR and the Australian Privacy Act.
11. Governing law
These terms are governed by the laws of Queensland, Australia. If you are a consumer living in the UK or the EU/EEA, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in its courts.
12. Changes to these terms
We may update these terms. The date at the top shows the latest version. Changes do not reduce rights you have already acquired for a period you have paid for.
